Cohen & Gresser advised Eiffel Investment Group in its recent €50 million investment with BTS DevCo into Green One, a platform aiming to scale biomethane production and cut greenhouse gas emissions across Italy.

Cohen & Gresser served as counsel to our client Procuritas and its portfolio company Nature Planet on all aspects of the transaction. The Cohen & Gresser team was led by Daniel H. Eiffel Investment Group, an alternative asset investor specializing in European credit and equities and a subsidiary of Cohen & Gresser client, the Impala Group, has reached a deal to acquire 100% of the ownership of Alto Invest, an independent asset management firm specializing in European small and mid-cap companies. Franck Le Mentec advised Impala on the tax aspects of the deal, while Angéline Duffour and Anna Milleret-Godet advised on the labor law aspects of the deal.
Franck Le Mentec authored Les demandes de brutage fiscal en matière d’arbitrage international d’investissement (Tax Gross-Up Claims in International Arbitration Procedures), which was published in Revue de l’arbitrage Vol. 2024, No. 1.

The submission of tax gross-up requests for indemnities that can be claimed during arbitration proceedings by the injured parties is critical. The objective of such requests is to include the tax consequences in the calculation made by the arbitrators of the compensation for damages. The analysis of arbitration decisions most often reveals a poor appreciation of this issue, whether on the part of the parties or the judges. Several remedies can be considered.
